Notaries Natalie von Rom and Dr. Andreas Jürgens as well as von Rom Jürgens Rechtsanwälte und Notare Partnerschaft (the “Partnership”) take the protection of personal data seriously and attach great importance on the security of your personal data.


We process your personal data only to the extent necessary for the contact you have requested or the notarial services you have commissioned, or as required by law. Notaries are furthermore subject to a statutory duty of confidentiality under § 18 of the Federal Code for Notaries. All employees of the Partnership are likewise bound to confidentiality. A breach of the notarial duty of confidentiality is generally punishable by law. We have concluded appropriate confidentiality agreements with all external service providers and processors to protect your data in accordance with legal obligations.

a) When visiting the website:


When you access our website (https://vonromjuergens.de) certain information is automatically sent from your browser to our website's server. This information is stored temporarily. The following data is collected without your intervention and stored until it is automatically deleted:

The legal basis for this data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the purposes listed above for data collection. If you contact us by email, telephone, or in writing, we record and store the data you provide (in particular your request to us, your email address, your name, and your telephone number), in particular to answer your questions. 


Data processing in connection with contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. e GDPR.

 

c) If you commission notarial services:


If you commission us to provide notarial services, we often require personal data from you that goes beyond the information specified in lit. b). The law requires the notary to collect, process, and — within the scope of her/his official duties — pass on data to third parties (e.g., tax offices or registry courts).


4. Disclosure of Data 


Your personal data will not be disclosed to third parties solely on the basis of your use of our website.


We will only disclose your data to third parties if:

  • the disclosure is necessary for the fulfilment of our notarial duties in accordance with Art. 6 para. 1 sentence 1 lit. e GDPR,
  • there is a legal obligation to disclose the data in accordance with Art. 6 para. 1 sentence 1 lit. c GDPR,
  • it is legally permissible and necessary for the performance of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR, or
  • you have given your express consent to do so pursuant to with Art. 6 para. 1 sentence 1 lit. a GDPR.



5. Betroffenenrechte


Sie haben gegenüber uns folgende Rechte hinsichtlich der Sie betreffenden personenbezogenen Daten:

  • gemäß Art. 15 DSGVO Auskunft über Ihre von uns verarbeiteten personenbezogenen Daten zu verlangen. Insbesondere können Sie Auskunft über die Verarbeitungszwecke, die Kategorie der personenbezogenen Daten, die Kategorien von Empfängern, gegenüber denen Ihre Daten offengelegt wurden oder werden, die geplante Speicherdauer, das Bestehen eines Rechts auf Berichtigung, Löschung, Einschränkung der Verarbeitung oder Widerspruch, das Bestehen eines Beschwerderechts, die Herkunft der Daten, sofern diese nicht bei uns erhoben wurden, sowie über das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling und ggf. aussagekräftigen Informationen zu deren Einzelheiten verlangen;
  • gemäß Art. 16 DSGVO unverzüglich die Berichtigung unrichtiger oder Vervollständigung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen;
  • gemäß Art. 17 DSGVO die Löschung Ihrer bei uns gespeicherten personenbezogenen Daten bei Vorliegen der gesetzlichen Voraussetzungen zu verlangen;
  • gemäß Art. 18 DSGVO die Einschränkung der Verarbeitung Ihrer personenbezogenen Daten bei Vorliegen der gesetzlichen Voraussetzungen zu verlangen;
  • gemäß Art. 20 DSGVO Ihre personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesebaren Format zu erhalten oder die Übermittlung an einen anderen Verantwortlichen zu verlangen;
  • gemäß Art. 7 Abs. 3 DSGVO Ihre einmal erteilte Einwilligung jederzeit gegenüber uns zu widerrufen. Dies hat zur Folge, dass wir die Datenverarbeitung, die auf dieser Einwilligung beruhte, für die Zukunft nicht mehr fortführen dürfen und
  • gemäß Art. 77 DSGVO sich bei einer Aufsichtsbehörde, in unserem Fall beim Hessischen Beauftragten für Datenschutz und Informationsfreiheit, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, über die Verarbeitung Ihrer personenbezogenen Daten durch uns zu beschweren.


5. Widerspruchsrecht


Sofern Ihre personenbezogenen Daten auf Grundlage von berechtigten Interessen gemäß Art. 6 Abs. 1 S. 1 lit. f DSGVO verarbeitet werden, haben Sie das Recht, gemäß Art. 21 DSGVO Widerspruch gegen die Verarbeitung Ihrer personenbezogenen Daten einzulegen, soweit dafür Gründe vorliegen, die sich aus Ihrer besonderen Situation ergeben.

  • Pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of the data, if not collected by us, and the existence of automated decision-making, including profiling and, where applicable, meaningful information about its details;
  • Pursuant to Art. 16 GDPR, to request the immediate correction of inaccurate or incomplete personal data stored by us;
  • Pursuant to Art. 17 GDPR, to request the deletion of your personal data stored by us if the legal requirements are met;
  • Pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data if the legal requirements are met;
  • Pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request its transfer to another controller;
  • Pursuant to Art. 7(3) GDPR, to revoke your consent at any time. As a result, we will no longer be allowed to continue processing the data based on this consent in the future; and
  • Pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority, in our case the Hessischer Beauftragten für Datenschutz und Informationsfreiheit, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, about our processing of your personal data.


6. Right to Object


If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons based on your particular situation.

We use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Nevertheless, we would like to point out that data cannot be comprehensively protected during transmission over the Internet according to the current state of technology.
